This is done automatically based on a number of factors, including number of filterss a person has. If it is a comment, shout out me or thenewgreen and we'll handle it.
Yikes. I didn't know about this. What exactly is the cap? It seems like someone could make a conflicting or provoking post or comment, spark an argument and get filtered by some people, and then get shadowbanned without ever getting a chance to correct themselves.

It's forgiving, and doesn't just take filtering into account. For a brand new account, there might be some risk, but is low. I keep an eye on it just in case. Here's a rare example of a user that tripped that switch:

There's just been a small spurt of submissions by what seems to be a repeat spammer who has in the past also done comment spam under a different account. Everything listed for the tinyurl.com domain is them. Not sure whether it's even possible to stop it, but you did ask about comment spam, so...
