After thinking about it for a bit, I think you might be right. The only argument I can think of as to why it's not a dystopia is that the series is about a war. The Yeerks were winning, but they didn't have absolute control yet. Society is in a state of flux instead of mostly stable. I'm not sure if you need a stable society to call it a dystopia, though.

Perhaps it's not so much a dystopia as it is a societal crisis. I mean, even in the Hunger Games, the point of the plot is generally about tumultuous revolution.
