You could argue that removing the canary in the future would constitute communication about the Section 251 order, and therefore removing it would be in violation of the gag order. I think these ideas are cute but does anyone really think they will work?

We've toyed with the idea, but more-or-less have concluded that we'd have little ground to stand on when push came to shove.

At the very least Apple has the legal resources for a good pushback, even if is primarily motivated for PR purposes, of which I am not sure.

That's a good question, I'm not sure that their intention is for it "to work". Perhaps, it's a direct way of indirectly challenging the NSA. You want to take us to task for this? We're going to make it public. You want to punish us for this? Okay, but you'll be doing it in the public space.

I can see that angle for it. I guess I'm more pessimistic to see it as an "all's fine here, don't worry" to the investors and customers. If we can't trust that it will really work, it feels a lot more like placation than resistance.
