That's sort of the point, right? It's a subjective thing and as such there should there be a law governing it. Free speech is free speech unless it directly endangers or libels someone/thing. It is subject to "certain restrictions" when necessary to protect the reputations/rights of others. There's some grey there. It's a tough call.
