When I shot concerts I either had permission or I didn't. This is a "you don't have permission except for this very specific purpose" (IE, taking pictures during Song 2 or 3, without flash, for the exclusive use of the named news or press agency ONLY). If the photographer isn't getting paid for the job, but only for the photos if they run, the photographer needs to negotiate a better rate from his client, not from Taylor Swift.
