Won’t matter by the time the lawsuit are done either the company will be successful and he will easily pay the token fine/settlement or the company will go bankrupt either way there won’t be restitution for those harmed. What he did was likely illegal but probably also the correct move. Likely pre planned or at least as a backup plan when he issued and sold the convertible bonds a while ago
