There should be no software patents. It would be like patenting a spoon. Nothing in software isn't self-evident to an experienced coder.

Even if that isn't the case, I still think software patents are dubious. Software is like language and math. There is creativity and problem solving, but not genuine invention, at least of the type that patents are designed to protect in order to spur innovation.
