I worry about this creating a disincentive for individuals or small firms to defend their good patents against bigger players but software patents seem broken so I guess it's worth a try.

Doesn't seem like too much of an issue to me. By my reading, even if you lose you aren't necessarily on the hook.
Of course, like so many laws, this one relies on the good judgement of the judges to determine what phrases like "reasonable likelihood of succeeding" mean.
