Wonder if we're heading toward a re-definition.Since 1980, the FCC has divided communication services into basic and enhanced categories; phone lines, with their “pure” transmission, are basic, while services like web hosting, which process information, are enhanced. Only basic services are subject to what are known as common carrier laws, which stop carriers from discriminating against or refusing service to customers.

Frankly, given the recent ruling, redefinition is the only way we'd be able to get any relief from the current status quo. I think the data backbones should be reclassified as "basic" while services like web hosting are spun off, though the carriers can still offer both.
